End User License Agreement

This End User License Agreement (“Agreement”) governs your use of PriusSpy (“the App”). Please read it before using the App.

1. Acceptance

By downloading, installing or using the App, you agree to this Agreement. If you do not agree, do not install or use the App. This Agreement is between you and GJSoft, a sole proprietorship established in the Netherlands (“we”, “us”), the developer of the App, and is separate from Google Play’s terms.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial use. You may not reverse-engineer, resell or redistribute the App except to the extent permitted by mandatory law.

3. What the App does

The App uses a separate third-party OBD-II (ELM327-type) Bluetooth adapter to read data from your 3rd-generation Toyota Prius and display information such as high-voltage battery health, motor-generators, inverters, the petrol engine, wheel sensors and stored Diagnostic Trouble Codes. The App reads information only: it does not write to, calibrate, code, program, clear, reset, or send control, actuator or configuration commands to any vehicle control unit, and it does not change the operating state of any control unit.

4. Not a professional or safety tool

The App is an information and hobbyist tool. It is not a certified diagnostic, safety or measurement instrument. Displayed values may be inaccurate, delayed, incomplete or misinterpreted, and depend on your vehicle, its software and the adapter used. Do not rely on the App for any decision affecting safety, vehicle roadworthiness, warranty or maintenance. Always consult a qualified technician and your manufacturer’s documentation.

5. Safe use — no use while driving

You must not operate, read or interact with the App while driving. Use it only when the vehicle is safely parked, or have a passenger operate it. You are solely responsible for operating your vehicle safely and lawfully and for complying with all laws regarding device and OBD-adapter use while driving. Leaving an adapter plugged into the OBD-II port is at your own risk; consult your vehicle documentation.

6. Third-party hardware

The App relies on a separate third-party OBD-II (ELM327-type) Bluetooth adapter that we do not manufacture, supply or control. Adapter quality varies widely, and some adapters — particularly low-cost clones — may transmit their own data onto the vehicle network independently of the App. We are not responsible for the behaviour, quality, firmware or effects of any adapter.

7. Assumption of risk

Connecting any device to a vehicle’s diagnostic port carries inherent risk. You use the App and any adapter entirely at your own risk and are solely responsible for choosing to connect to your vehicle.

8. “As is” — no warranty

To the maximum extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App is error-free, compatible with your vehicle, or that it will produce correct results.

9. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, vehicle damage, diagnostic expense, loss of use or personal injury, arising out of or relating to the App or any connected adapter. Our total aggregate liability for all claims is limited to the greater of the amount you actually paid for the App in the 12 months before the claim, or EUR 10.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your use or misuse of the App, your connection to a vehicle, or your breach of this Agreement, except to the extent caused by our proven gross negligence or wilful misconduct.

11. Mandatory consumer rights

Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our gross negligence or intent, or your non-waivable rights as a consumer under the mandatory law of your country of residence. Where any clause is unenforceable, it is limited or severed to the minimum extent necessary and the remainder stays in force.

12. Governing law

This Agreement is governed by the laws of the Netherlands, without prejudice to the mandatory consumer-protection rules of your country of residence.

13. Changes and termination

We may update this Agreement; the “last updated” date above will change, and continued use after an update means acceptance. We may suspend or terminate the licence if you breach it. Sections 4–11 survive termination.
